Case Study: Lead Paint
Our clients were the family members of a young boy who was diagnosed with lead poisoning at the age of five. This family lived in low-income housing in Iowa that, unknown to them, was painted with lead-based paint that peeled and cracked from the walls. Their little boy, like many young children have done, ingested chips of the peeling paint. The lead poisoning resulted in neurological damage, causing the boy to be severely developmentally delayed. He was still unable to talk at the age of five.
Baron & Budd brought suit against the family's landlord. As the case progressed, it became apparent that the landlord knew that the family's apartment contained lead-based paint before the family ever moved in. In fact, the landlord had been cited by the government for violations of lead-based paint regulations in the past. Not only did the landlord fail to correct the problem, but he also failed to warn the boy's parents about the health hazards posed by the paint.
Shortly before trial, Baron & Budd reached a confidential settlement with the landlord. A trust has been set up for the boy, whose irreversible neurological damage may prevent him from being able to support himself as an adult
